1. Purpose and scope
These General Terms and Conditions of Sale (GTC) define the contractual rights and obligations between the company BAMDIGI SARL, operating the Noor Gourmet brand (hereinafter "the Seller"), and any natural or legal person making a purchase on the website www.noor-gourmet.com (hereinafter "the Customer").
These Terms and Conditions govern all sales of food products, including products considered perishable or with a limited shelf life. Any order placed on the website implies the Customer's full and unreserved acceptance of these terms and conditions.
2. Products and compliance
The products offered for sale on the Noor Gourmet website are described and presented as accurately as possible. However, minor variations may exist, particularly in the presentation of handcrafted products.
Photographs, descriptions and visuals are provided for illustrative purposes only and have no contractual value.
3. Orders
The Customer can place an order via the website www.noor-gourmet.com. The order becomes firm and final upon full payment of the price by the Customer and order confirmation sent by the Seller.
The Seller reserves the right to refuse any order from a Customer with whom there is a prior dispute or payment incident.
Any confirmed order constitutes an irrevocable acceptance of prices, products and terms of sale.
4. Price and payment terms
The prices shown on the website are in euros, inclusive of all taxes (VAT). They do not include delivery charges, which are specified during the order process.
The Seller reserves the right to change its prices at any time without notice, but products will be billed based on the prices in effect at the time the order is validated.
Payments are made online by credit card or any other method offered on the website. Payment is secured through a certified provider. In case of payment refusal, the order is automatically cancelled.
5. Product Availability
Product offers are valid while stocks last. If a product becomes unavailable after order confirmation, the Seller will inform the Customer as soon as possible and offer a refund or an equivalent product.
6. Shipping and Delivery
Orders are prepared and shipped from mainland France. Processing times generally vary between 24 and 72 business hours from payment confirmation.
6.1. Delivery methods and times
Delivery times and costs are indicated before order confirmation. As Noor Gourmet products are stable at room temperature, they can be shipped without refrigeration, in secure and appropriate packaging.
6.2. Receiving the package
The Customer agrees to be present for delivery and to immediately check the condition of the package. In the event of apparent damage or anomaly (missing product, damaged package, incorrect item), it is the Customer's responsibility to make specific reservations on the carrier's delivery slip and to inform the Seller within a maximum of 48 hours, accompanied by supporting photographs.
6.3. Non-receipt, refusal or failure to collect the package
In accordance with Article L221-28 of the Consumer Code, Noor Gourmet products being perishable or time-limited food products, no right of withdrawal, refusal or refund can be granted once the order has been validated and shipped.
Consequently: - If the Customer refuses the package or fails to collect it within the time frame specified by the carrier, no refund or replacement will be issued. - The Seller cannot be held responsible for product deterioration resulting from a delay in collection, improper handling by the Customer, or failure to comply with the carrier's instructions.
7. No right of withdrawal
Pursuant to Article L221-28, 4° of the Consumer Code, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly.
All products offered on the website www.noor-gourmet.com being food products, no cancellation, modification or withdrawal can be exercised after validation and payment of the order.
The Customer therefore does not have a 14-day period to return the products, even if unopened.
8. Claims and returns for non-conformity
In the event of a proven defect, missing product or incorrect reference, the Customer must send a written claim to Noor Gourmet customer service within 48 hours of receiving the package, accompanied by clear photos of the product and its packaging.
After analysis, the Seller may offer appropriate compensation: replacement, credit note, or partial refund. No product returns will be accepted without the Seller's prior agreement.
The products must not have been consumed or opened under any circumstances.
9. Customer Responsibility
The Customer is required to store the products under conditions that comply with their nature and health regulations: - Storage in a clean, dry place away from heat or humidity; - Consumption before the DM (minimum durability date) indicated on the packaging; - Handling in compliance with food hygiene rules.
Any alteration, deterioration or loss of quality resulting from improper storage cannot be attributed to the Seller.
10. Legal Guarantees
Noor Gourmet products benefit from the legal guarantees of conformity (articles L217-3 to L217-17 of the Consumer Code) and against hidden defects (articles 1641 to 1649 of the Civil Code).
All guarantees are excluded in the event of failure to comply with storage conditions, improper use or exceeding the minimum durability date.
11. Seller's Responsibility
The Seller undertakes to deliver a product that complies with French and European regulations. The Seller shall not be held liable in the event of: - force majeure or unforeseen event rendering performance impossible; - indirect damage (loss of profits, loss of opportunity, commercial loss); - failure by the Customer to comply with storage, transport or hygiene conditions.
12. Force majeure
The Seller is released from its obligations in the event of the occurrence of a force majeure event as defined by French case law (strike, logistical failure, natural disaster, war, administrative decision, etc.).
13. Customer Service
For any complaints or questions regarding an order, the Customer can contact Noor Gourmet via the website's contact form. A response will be provided as soon as possible.
14. Mediation and dispute resolution
In the event of a dispute, the Customer is encouraged to seek an amicable solution with customer service.
In accordance with Article L612-1 of the Consumer Code, the consumer Client may use the consumer mediator CMAP – Consumer Mediation Service, 39 avenue Franklin D. Roosevelt, 75008 Paris (www.cmap.fr) free of charge.
Any dispute that cannot be resolved amicably will be submitted to the competent French courts. French law alone will apply.
15. Intellectual Property
All content on this website (texts, images, logos, trademarks, photographs, graphic design, etc.) remains the exclusive property of Noor Gourmet / BAMDIGI SARL. Any reproduction or distribution, even partial, is strictly prohibited without prior written authorization.
16. Personal Data
The personal information collected on this website is necessary for order processing and customer relationship management. It is processed in accordance with the General Data Protection Regulation (GDPR). Customers have the right to access, rectify, object to, and delete their personal data via the website's contact form.
17. Final Clause
The Seller's failure to invoke a breach by the Customer does not constitute a waiver of the right to invoke it subsequently.
If any clause of these terms and conditions is deemed invalid or unenforceable, the other provisions shall remain in full force and effect.
